A deposit is payable immediately to confirm the booking. The full rental payment is to be made not less than 1 month prior to the booking commencement. Non-receipt of full payment by the due date will be treated as a cancellation.
Cancellations must be confirmed in writing. Any refund will be paid on receipt of this confirmation. If the cancellation is confirmed more than 1 month prior to the reservation only the deposit is charged. If the confirmation is less than 1 month prior to the reservation then full rental is charged. The owners undertake to use their best endeavours to re-let a cancelled reservation. If successful a full refund will be made less the owners expenses.
3. The Booking
In the event of a signed Booking Form not being submitted with the deposit, the deposit itself indicates acceptance of the these terms and conditions, which form a contract between you and the owners.
4. The Tenancy
The tenancy confers upon the Tenant the right to occupy for a holiday within the meaning of section 9 of the Rent Act 1977.
Lettings are for a maximum of four weeks and, unless otherwise agreed in writing, commence at 3.00pm on the first day of the let, ending at 10am on the day of departure.
Holiday and travel Insurance, including cancellation cover, is essential for your own protection and we strongly recommend that you and all members of your party be suitably insured.
The owners of White Horse Farm accept no liability to any tenant of a holiday party for any personal injury, illness, loss or damage to property however sustained or caused nor for the loss or theft of any property or money during their stay. The use of the holiday cottage and all amenities provided by the owners are provided to the tenant entirely at the users risk.
8. Tenants Obligations
The tenant agrees:
(a) to pay for any losses or damages to the property however caused (reasonable wear and tear excluded). All damages must be reported immediately and paid for in full prior to the tenant’s departure. Anything discovered when the tenant has left will be billed for by post.
(b) to permit the owners reasonable access to the property.
(c) not to cause annoyance or become a nuisance to occupants of nearby or adjacent properties.
(d) not to part with possession of the property, or share it save with members of their party.
The owners would appreciate the cottages being left in good order on the tenant’s departure. The owners reserve the right to charge a minimum of £15.00 for excessive cleaning (if deemed necessary).
The total number of persons staying in the cottage must not exceed the booked and agreed cottage bed capacity.
11. Non Availability
If for any reason beyond the owners control the property is not available on the date booked (damage by fire for example) or the property is unsuitable for holiday letting, all payments made in advance by the applicants will be refunded in full but the applicants shall have no further claim against the owners.
All or any complaints must be notified to the owners immediately so that an on site investigation can be made and, if necessary, remedial action taken. In no circumstances will compensation be paid for complaints raised after the tenancy, by when the owners will have been denied the opportunity to investigate and endeavour to put right any such matter, during the tenancy.
13. Breach of Contract
If there shall be any breach of these conditions the owners reserve the right to re-enter the property and terminate the tenancy without prejudice to the other rights and remedies of the owners. The contract is deemed to have been made at White Horse Farm, Middlemarsh, Dorset, DT9 5QN and the proper law of the contract is English.
Bed linen and towels are provided free for the number of people booked.
Well-behaved dogs and other pre advised (and agreed to) pets are welcome on the understanding that due consideration for the cottages, furnishings, grounds and other guests is observed at all times. They must not be left unattended in the cottages and any stains or damages will have to be charged for.
